The resumption of federal executions by the U.S. Justice Department after a decade-plus hiatus may affect the future of death-penalty litigation.

Federal executions remain challenged in the high courts due to petitions from federal inmates, as well as federal justices who have differing opinions on the Death Penalty Act which mandates execution protocols and methods, such as the use of lethal injection. With states varying in their methods of execution, there is a lack of clarity at the federal level in using these protocols and whether they follow the law.

It will be crucial that justices of the high courts look into these cases and not wait to resolve differences of opinion. For more information on the resumption of federal executions please visit DPIC Federal Death Penalty Information.
